You agree to indemnify The Lighthouse for any improper, unauthorized or illegal use of your account by you or by any person obtaining access to the Services or otherwise by using your designated username and password, whether or not you authorized such access.

• when completing our registration form, you will only use true, accurate, current and complete information about yourself.

• You will maintain and promptly update the registration data and information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or if we have grounds to believe that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these terms of use, without prejudice to any other rights and remedies of The Lighthouse under these terms of use or at law, we have the right to indefinitely suspend, limit or withdraw your membership and access to the Site.

We may, in our sole discretion and at any time, make any inquiries we consider necessary (whether directly or through a third party), and request that you provide it with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. Without limiting the foregoing, if you are a business entity or registered on behalf of a business entity such information or documentation may include your incorporation documents and/or documentation showing any person’s authority to act on your behalf. You agree to provide any information and/or documentation to us upon such requests. You acknowledge and agree that if you do not, we may limit, suspend or withdraw your access to the Site. We also reserve the right to cancel unverified accounts or accounts that have been inactive for a long time.

You agree and undertake to provide all information and materials as may be reasonably required by The Lighthouse in connection with your transactions conducted on, through or as a result of use of the Site.  We have the right to suspend or terminate any user’s account if the user fails to provide the required information and materials.

We wish to ensure that the users of the Site are able to form legally binding contracts and further that minors do not purchase unsuitable content. Therefore using of the Site is not available to persons under the age of 18 years. You represent that you are 18 years of age or over the age of 18 years before you become a user of the Site. Without prejudice to any other rights and remedies of The Lighthouse under these terms of use or at law, we reserve the right to limit or withdraw access of any person to the Site if we believe such person is under the age of 18 years. The Site is not available to persons whose membership has been suspended or withdrawn by The Lighthouse. “The Lighthouse” and its logos is a registered trademark in the food and beverage sector of the United Arab Emirates.

By using The Lighthouse website, you are aware that any violation of this part of the Agreement shall automatically revoke your right to access this website and you must destroy any copies you have made of any part of the Content.

You agree NOT to:

(1) Impose an unreasonable load on The Lighthouse website’s infrastructure or take any action that might risk doing so.

Item prices quoted on The Lighthouse website do not include shipping and taxes. By purchasing an item, you

(a) Agree to pay for taxes and shipping charges added to the total amount.

(b) Agree to make purchases only for personal use and not to engage in any reselling or distribution of items.

We reserve the right to cancel or reject any order you make if we have reason to believe that your order did not comply with the above mentioned terms and conditions.

Orders are subject to our acceptance or rejection based on availability of products.

We provide shipping services through a third party, Aramex, to simply facilitate the delivery of purchased products on thelighthouse.ae to customers. The service connects the customers with some of the carriers providing them with pre-negotiated pricing and tightly-coupled integrations to enable shipping with ease.

We do not assume any liability of any kind whatsoever in relation to the shipping services provided by the carries we connect you with.

The information about the products are used to automatically generate the shipping rates and transit times for the buyer(s).

By using the shipping services, you agree to the carrier’s terms and conditions.

If the customer is in Dubai, we will aim for the next-day delivery. Shipments within the UAE will typically take 3-4 business day. The customer has to take into account that shipments may take a longer time.

After the customer has placed their order and their payment has been processed, they are not eligible anymore to cancel the order, however, they can exchange the items purchased with any other item(s) offered at thelighthouse.ae of the same value subject to the terms hereunder

The customer is eligible for an exchange within seven calendar days of the receipt of their shipment. But the item must be in its original condition as sold, or completely unopened. Any item that has been opened or damaged will not be exchanged.

If the customer is located in Dubai and is interested in exchanging their purchase for an item within the physical store, they may do so. Provided however that the original item has not been opened and the value of the new purchase is of the same value or greater than the original.

The Lighthouse team takes extreme care of its items and make sure it is in mint condition before being shipped to the customer. We cannot take responsibility for any damage that has occurred to it after leaving our premises. Please email us directly at help@deepaks13.sg-host.com with a proof of purchase and proof of damage so that we may assess your case with our shipping company and replace your item with a new one if necessary.

Though we take our orders seriously and check each one meticulously, we cannot guarantee being free of errors. We shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, equity or otherwise or any other damages resulting from any of the following:
• the use or the inability to use the Site;
• unauthorized access by third parties to data or private information of any user;
• statements or conduct of any user of the Site; or;
• any matters relating to use of the Site however arising, including negligence.

Notwithstanding any of the foregoing provisions, the aggregate liability of The Lighthouse, our employees, agents, affiliates, representatives or anyone acting on our behalf with respect to each user of the Site for all claims arising from the use of the Site shall be limited to purchase price of the products to such user provided it will not exceed the minimum amount permitted in the applicable law. The preceding sentence shall not preclude the requirement by the user of the Site to prove actual damages. All claims arising from the use of the Site must be filed within three (3) months from the date the cause of action arose or longer period as prescribed under any applicable law governing these terms of use.

Notice to a member shall be deemed to be received by such member if and when we are able to demonstrate that communication, whether in physical or electronic form, has been sent to such member, or immediately upon posting such notice on an area of the Site that is publicly accessible without charge.

You agree that all agreements, notices, demands, disclosures and other communications that we send to you electronically satisfy the legal requirement that such communication should be in writing.

These terms of use are governed by, and construed in accordance with, UAE law.

Dubai Courts shall have jurisdiction over any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms of use, the Private Policy and all policies referred to herein or their subject matter or formation. Nothing in this clause shall limit the right of The Lighthouse to take proceedings against a user of the Site in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
